Civil liability insurance of enterprises that utilize hazardous facilities
Enterprises operating hazardous production facilities are obliged to insure their liability (article 15 of Federal Law “On Industrial safety of hazardous production facilities” No 116-FL as of 21.07.97). Here it is not only the question of compliance with legal norms but also of how each company understands and fulfills its obligations before the public. Insured persons can be:
Organizations, enterprises operating hazardous mining, metallurgical, chemical, petrochemical and oil-refining industry facilities, gas supply, water treatment, heat and electric power systems, etc;
Enterprises using hoisting equipment – various hoisting cranes, elevators, lifts, escalators, etc.
Insurance terms:
An insurance event is the case of the Insured person’s civil liability for damage caused to life, health and property of third parties or the environment as a result of an accident taking place at a hazardous production facility operated by the Insured person and indicated in the Insurance agreement.
An accident at a production facility is destruction of the facility and (or) technical equipment and also uncontrolled explosion and (or) emission, discharge, spillage of hazardous substances.
A minimum insurance premium (RUR100.000, RUR1.000.000 or RUR7.000.000), is prescribed by the legislation for each category of hazardous facilities and can be increased as agreed by the parties.
The insurance compensation can be paid upon the effective court ruling prescribing the compensation for the damage caused or in the pre-trial order.
Insurance compensation includes:
Damage caused by destruction of or damage to the affected parties’ (natural and legal entities) property;
Damage to life or health of the public, including the compensation of revenue lost by the affected party as a result of disablement;
Recuperation expenses;
Share of revenue lost by the persons dependable on the affected party as a result of his/her death;
Environmental damage;
Expenses incurred by the customer to reduce losses;
Expenses associated with the elimination of consequences of an accident at a facility.
